General Information
MB Mapted (hereinafter referred to as the "Data Controller") is the operator of this Mobile Application. This Privacy Policy (hereinafter referred to as the "Privacy Policy") establishes and explains how the data of the Users of the Mobile Application is collected and processed. The Privacy Policy also provides information about the processing of other data subjects' data carried out by the Data Controller in the course of its activities.
The Privacy Policy applies to all persons who have downloaded the Mobile Application, and the conditions set out in it apply each time you want to access the content and/or services provided by the Data Controller, regardless of the device (mobile phone or tablet) you use.
All data subjects' data is processed lawfully, for pre-defined purposes, and only to the extent necessary to achieve them. When processing Users' personal data, the Data Controller complies with the General Data Protection Regulation No. 2016/679 (hereinafter referred to as the "GDPR"), the Law on Legal Protection of Personal Data of the Republic of Lithuania, as well as the requirements for the processing of personal data established in other legal acts and recommendations and/or instructions of supervisory authorities.
Persons under the age of 14 are not permitted to submit any personal data in the Mobile Application and/or social media accounts, consent of legal representatives (parents, adopters, guardians, or custodians) must be obtained before providing any personal information.
The terms used in the Privacy Policy are understood as defined in the GDPR and other legal acts regulating the protection of personal data.
Anonymity
Upon logging into the Mobile Application, no other personal data will be required except for the name, email, and phone number. To use the Mobile Application, the User does not have to provide any other personal data.
- The use of the Mobile Application requires:
- Contact information necessary for communication between the seller and the buyer. This can be provided when creating/uploading each advertisement individually. If not provided, communication between the client and the seller will only be possible through the Mobile Application.
Privacy
No collected data that could be directly associated with the User will ever be shared with third parties. Personal data – name, email, phone number – will not be disclosed, except in the case of disputes resolved in court.
How the Data Controller collects information about the User
User personal data is obtained in the following ways:
- Personal information provided in the Mobile Application profile form;
- Information about the User may be collected automatically.
What information about the User is collected and stored in the Data Controller's database:
Contact information provided in the personal profile form:
- Name;
- Email;
- Phone number.
Automatically collected data is categorized as follows:
- Primary level data (collected without the option to opt-out):
- Information necessary to defend the Data Controller's interests in court or another institution, and stored in the Data Controller's database for 90 calendar days:
- Advertisement data after the deletion of the advertisement initiated by the User;
- User profile data.
- Information received from User inquiries.
- Mobile application usage statistics not linked to specific users.
- Secondary level data (collected with the option to opt-out):
- Mobile Application usage statistics;
- Product search statistics.
For what purposes is the User's data processed:
- For the provision of services, enabling the use of the Mobile Application features;
- For marketing purposes;
- For service quality improvement purposes;
- For the fulfillment of the Data Controller's obligations under applicable legal acts;
- For the internal administration and accounting management of the Data Controller;
- For the determination of the quality of online services provided by the Data Controller and ensuring the functionality of the Mobile Application.
User's personal data is processed based on lawful personal data processing grounds:
- User consent;
- Compliance with legal requirements;
- Legitimate interests of the Data Controller.
To whom the User's data is transferred:
Without the User's prior written consent, their personal data may be transferred in the following cases:
- To law enforcement and state authorities, by court decision;
- To other entities when required by law or necessary to protect the legitimate interests of the Data Controller;
- In other cases, as provided by law.
Can the User's data be transferred to foreign countries?
The Data Controller does not transfer any User personal data to third countries, i.e., countries outside the European Economic Area.
User data security:
- Minimal personal data collection;
- Secure data centers.
The Data Controller points out that even when taking appropriate measures to protect the User's personal data, no website, online transaction, computer system, or wireless internet connection is completely secure.
How long is the User's data stored?
If the User has not performed any actions related to buying/selling directly through the Mobile Application, all data is deleted after the User deletes their account in the Mobile Application.
If the User has performed actions related to buying/selling directly through the Mobile Application (advertisements posted, confirmed by the Data Controller), all User data is stored for 90 calendar days from the date the User deleted their account in the Mobile Application.
User Rights
Depending on the situation and the additional conditions approved by the GDPR, the User has the following rights:
- To know (to be informed) about their data processing (Right to Know);
- To access the personal data processed by the Data Controller and how it is processed (Right to Access);
- To request the correction or, considering the purposes of personal data processing, to supplement incomplete User personal data (Right to Rectification);
- To request the deletion of personal data related to the User (Right to Be Forgotten);
- To request that the processing of the User's personal data be restricted (Right to Restriction);
- To request the transfer of submitted data (Right to Data Portability);
- The User may at any time object to the processing of their personal data when such processing is carried out for the purposes of public interest, for the legitimate interests of the Data Controller or a third party, or when personal data is processed for direct marketing purposes, including profiling (Right to Object);
- To withdraw consent for the processing of personal data if the data is processed based on consent.
The Data Controller aims to ensure the User's rights appropriately and promptly respond to any possible violation of their implementation. Therefore, if any questions arise regarding the processing of the User's personal data, the User should first contact the Data Controller. The User has the right to file a complaint with the State Data Protection Inspectorate at any time.
The Data Controller provides the User with the opportunity to exercise these rights conveniently. This can be done by contacting the Data Controller at info@mapted.com.
External Websites
The Mobile Application may contain links to external websites, e.g., websites of suppliers of goods and/or services advertised by the Data Controller. When following such links, the User should note that these websites and the services accessible through them must have their separate privacy policies (rules), for which the Data Controller assumes no responsibility. Therefore, it is recommended to review the privacy policies of external websites in detail before providing any personal data.
Communication
In case of noticing any inconsistencies in the Privacy Policy or security gaps on any of the Data Controller's websites or having other questions related to the processing of the User’s personal data, Data Controller must be contacted in one of the following ways: via message in the Mobile Application. or via email at info@mapted.com.
Final Provisions
The Privacy Policy is reviewed and updated as necessary, following changes in the laws regulating the processing of personal data. After updating the Privacy Policy, the Data Controller informs the User of significant changes by sending a notice via email or posting information in the Mobile Application's information system.
After such a notice has been posted, the User is deemed to agree with the new requirements set out in the updated Privacy Policy by continuing to use the content and/or services provided by the Data Controller.
By using the Mobile Application, the User confirms that they have read this Privacy Policy and understand its provisions.
